Our terms and conditions
We (Spyre Limited) supply graphic design and creative artwork to our clients (that’s you) for print, web and display. We source and manage additional skills such as photography, copy writing and illustration where necessary. We also purchase print and can project manage these tasks on your behalf which will be billed to you by Spyre Limited. We do not share our suppliers and partners contact details with our clients as we often source the most appropriate supplier for each project on an individual basis. If you wish us to work with your own resources, we will charge our liaison time with them at our hourly rate.
All design work carried out by Spyre Limited is on the understanding that the client has agreed to these terms and conditions.
What you are buying
You are purchasing one final piece of creative graphic design based upon the written information received from you or members of your staff.
For printed work, high resolution print ready PDF files will be available to you. You may supply these files to other designers and printers and use them however you wish. You will need to archive them within your own system as we may not store them indefinitely.
What you are not buying
You may be presented with several options en-route to the final design – these additional options do not form part of our agreement and may incur an additional charge. If you wish to use them elsewhere this will require our written consent.
Our working files such as layered Photoshop documents, native Illustrator and InDesign files or bespoke code remain the property of Spyre Limited and do not form part of our agreement.
Fonts purchased by Spyre Limited will not be supplied to clients or third parties as they are subject to copyright and licensing laws beyond our control.
Our first business with a new client will require payment immediately upon completion of each stage outlined within the estimate. Subsequent credit terms can be agreed with prior consent up to 30 days only.
You may pay by bank transfer or business cheque payable to Spyre Limited.
We are VAT registered and are required to charge VAT at the prevailing rate (Registered number: GB 731 7543 38).
All works remain the property of Spyre Limited until payment has been made in full.
When we have the go-ahead to produce work for you we will require a written brief outlining the requirements for your job. All known facts need to be specified if they are to be included and delivered within the creative budget.
It is the client’s responsibility to ensure their staff have the authority to place orders with Spyre Limited.
We work on a time and materials basis, at your request we will supply an estimate outlining costs for known elements of the job. This estimate allows for any supplied information to be supplied efficiently. Typing in copy or deciphering complicated spreadsheets will be charged additionally by the hour. Un-estimated work will be carried out at the current hourly rate plus VAT.
We take enormous pride in the quality of our artwork and are extremely conscientious. However, proof reading is the responsibility of the client. We can provide an estimate for professional proof reading services if required.
Additional expenses may be applied for any necessary service, including, but not limited to, art direction and photography, image searches, media conversion, digital image processing, or data entry services.
Spyre Limited hold no responsibility for web development, printing or other services sourced and employed by the client.
The customer agrees that requested revisions that are over and above the estimated work, or required to be carried out after acceptance of the draft design, will be liable to a separate charge. Spyre Limited holds no responsibility for any amendments made by any third party, before or after a design is published.
Any indication given by Spyre Limited of a completion date of a project is to be considered by the customer to be an estimation. Estimated project duration should be deemed to be from the date that a written brief, purchase order or other instruction is received by Spyre Limited.
A design project is considered complete upon receipt of the customer’s emailed or written approval. Printed projects may incur additional charges if amendments are made after the file has been approved for print by the client.
Portfolio and social media
The customer grants Spyre Limited permission to use our design work freely in our portfolio, on our website or on our social media unless specifically requested otherwise.
Licensing and legals
The customer is responsible for ensuring all copyright and usage permissions has been obtained when supplying photography, illustration or any other works to Spyre Limited.
Spyre Limited is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold Spyre Limited responsible for any such loss or damage. Any claim against Spyre Limited shall be limited to the relevant fee paid by the customer.
These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Spyre Limited reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.
Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this, Spyre Limited will need formal notification in writing. Spyre Limited will then issue an invoice for all work completed including print that has been ordered. The balance must be paid within 30 days.
